Winder Police Arrest Driver who Refused to Sign Citation

Winder police arrested a 34-year-old man Sept. 13 after he refused to sign a citation he was being issued for a traffic violation.

Andrew McClellan Davidson of 1415 Landing Way in Winder was charged with driving on the wrong side of the road, disorderly conduct and obstructing or hindering a law enforcement officer and resisting arrest after he was pulled over on Athens Street when an officer observed his vehicle traveling on the wrong side of the road.

When the officer gave Davidson a citation for driving on the wrong side of the roadway and asked him to sign the ticket, Davidson refused.

“He stated that I was not going to give him a citation and he placed his foot on the brake and his hand on his gear shift which lead me to believe that he was going to drive off,” the officer wrote in his report. “I asked him again to sign the citation and he stated ‘hell no’.”

The officer then told Davidson that if he did not sign the citation, Georgia laws indicate there is an expectation that the driver will not appear in court and it is an offense for which the driver can be arrested.

“After asking him several times if he was going to sign the citation I ordered him out of the car,” the officer wrote. “He did not get out but began yelling that he would sign the citation.”

Davidson was removed from his vehicle after a second officer arrived at the scene and was taken into custody.
