Winder Man Threatens to Sue County, Officer During Arrest

The incident occurred about 4:30 p.m. Tuesday, Sept. 11, outside a Winder grocery store.

A Winder resident who was arrested Tuesday, Sept. 11, outside a local grocery store threatened to sue the county and the arresting officer. 

The officer responded to the Winder in reference to a disorderly suspect who had a verbal disagreement with the store manager. When the officer exited his patrol vehicle and approached the suspect, whom the officer recognized from previous incidents, the suspect was reportedly loud and boisterous and began to curse at the officer, asking who had called police. 

The officer then told the suspect to put his hand behind his back and placed him under arrest.

"He continued to cuss and asked why I was locking him up," the incident report reads. "He stated that it as a racial thing and that he was going to sue the county and myself." 

According to the Ingles store manager, the suspect had been yelling inside and employees had problems with the man in the past. The suspect was then barred from the store before being transported to the .

Hoyt Hayes, 58, of 249 Capital Ave. in Winder was charged with disorderly conduct and public drunkenness.
