Driver Charged with DUI, Open Container After Arrest in Waffle House Parking Lot

Police stopped the driver for playing loud music and found an open container of alcohol after she asked an officer to look for money inside her vehicle.

A woman whose vehicle was stopped Aug. 4, 2012, driving around the Winder parking lot faces charges for DUI and possession of an open alcohol container. 

According to a incident report, officers had been dispatched to the eatery in reference to a report of a large crowd and someone bringing alcohol into the establishment. When police arrived, they observed a female driving a vehicle around the parking lot with music playing loudly. When an officer yelled to the driver to turn her music down, she continued driving. The driver was then stopped by police and said she couldn't hear the officer yelling because her music was too loud.

When asked if she had been drinking, the female said she had a margarita an hour-and-a-half before. When asked to exit her vehicle, the female said she was looking for her other sandal to put on. When she couldn't find the sandal, she put on a pair of heels. After exiting the vehicle, the driver was asked again how much she had been drinking due to a strong odor of alcohol. The female said she had consumed two margaritas and a shot and could get someone to drive her home.

An officer then performed a field sobriety evaluation on the driver before placing her under arrest for DUI. The driver then asked that her cell phone and money be retrieved from her vehicle. While searching for the money, an officer found an open, 16-ounce can of Cayman Jack margarita-flavored malt beverage that was half full and cool to the touch. 

Marzondria Shakitta Mims, 25, was transported to the , where two breath samples were taken registering .142 and .150, respectively.
